Friday, September 4, 2009Plaintiff had been working for 2 weeks for a temporary employment agency who had dispatched plaintiff to a newly opened, state of the art, waste recovery and transfer station. Plaintiff suffered a brain injury when he was cleaning a subterranean truck transfer tunnel and trash from above, specifically a television, struck plaintiff on the head. We defeated defendant’s claims that plaintiff was a special employee who would have been limited to worker’s compensation. Plaintiff’s injury resulted in a fractured skull, cognitive loss, and vision impairment in one eye.
