Plaintiff, a 32 year old Hispanic housewife and mother of 3 children, was walking along the sidewalk and was struck by defendant's vehicle at a driveway. Defendant contested liability and argued that plaintiff stepped out into the street because the angle of the driveway pulled her stroller into the street. Defendant also contended that Plaintiff had to have stepped out into the path of her vehicle because other pedestrians directly in front of and behind Plaintiff were not struck by Defendant's vehicle.
